Terms and Conditions: Sell Your Car

Nothing contained in these Terms and Conditions will affect or restrict the statutory rights of a consumer.

These Terms and Conditions govern the sale of your vehicle (“Vehicle”) to our company (named overleaf) (“We,” “Us,” or “Our”). By agreeing to sell your Vehicle to Us, you accept these terms and conditions in full. 

1. PARTICIPATING DEALERSHIPS 

1.1 The sale of your Vehicle is only applicable to dealerships owned and operated by the Lithia UK group of companies, limited to those trading as Stratstone BMW, MINI, Jaguar, Land Rover and Mercedes Benz, Audi, Porsche, Ferrari, McLaren and Aston Martin which are listed on https://www.stratstone.com/shop/car-valuation

2. VALUATION OF THE VEHICLE 

2.1 Any valuation provided for your Vehicle, whether online, in writing, or verbally, is valid for seven (7) days from the date it is issued. 

2.2 The valuation is based on the information you provide about your Vehicle, including but not limited to its condition, mileage, service history, and ownership details. 

2.3 All valuations are subject to inspection of the Vehicle and verification of the information provided. 

2.4 We will not purchase any Vehicle unless you have owned it for a minimum of six (6) months. 

3. REPRESENTATIONS

3.1 Our agreement to purchase the Vehicle will be subject to confirmation that: (i) you are the legal owner of the Vehicle and have the right to transfer legal ownership of the Vehicle to Us; (ii) the Vehicle is not subject to any undisclosed finance; (iii) you have declared all encumbrances or interests to which the Vehicle is subject; (iv) the particulars of the Vehicle given by you are correct and that so far as you are aware the milometer reading is accurate and the odometer has not been tampered with; (v) other than as declared by you in writing, there are no physical, mechanical, structural or bodywork defects with the Vehicle; (vi) other than as declared by you overleaf and so far as you are aware the Vehicle has not been the subject of an accident or any other damage or any insurance claims or total loss claims; (vii) other than as declared by you overleaf the Vehicle was first supplied by the manufacturer’s official distributor for the UK; (viii) the Vehicle has not been used as a taxi, for private hire, or for any commercial purposes. It has been maintained solely for private, non-commercial use; (ix) other than as declared by you, the date of first registration on the registration documents is the date on which the vehicle was new and first used; and (x) you are not registered for VAT and VAT is not chargeable on the agreed price payable to you. 

4. APPRAISAL OF THE VEHICLE

4.1 You must make an appointment at a participating dealership via https://www.stratstone.com/shop/car-valuation in order to have your vehicle appraised.  

4.2 The Vehicle must match the description provided by you at the time of valuation. 

4.3 Any discrepancies, including but not limited to undisclosed damage, mechanical faults, or modifications, may result in a revised valuation. 

4.4 We reserve the right to withdraw or amend any valuation if: (i) the Vehicle’s condition is not as described, (ii) the Vehicle has outstanding finance that was not disclosed, or (iii) any other undisclosed information is discovered.

4.5 If the vehicle does not meet our appraisal standards, we may, at our discretion, refuse the purchase or offer a revised price based on the appraisal results.

5. DOCUMENTATION & ACCESSORIES REQUIREMENTS

5.1 At the time of the Vehicle’s appraisal or sale, you must provide: (i) the Vehicle’s V5C registration document (logbook); (ii) a valid MOT certificate (if applicable); (iii) the Vehicle’s service history and any available receipts for repairs; (iv) a valid form of identification (e.g., driver’s licence or passport); and (v) proof of address (e.g. a utility bill or bank statement in each case being less than 3 months old at the date of your appointment).

5.2 At the time of your appointment with the participating dealership, you must provide Us with: (i) all copies of the Vehicle’s keys in your possession; (ii) the Vehicle’s handbook; and (iii) any accessories related to the Vehicle such as the locking wheel nut. 

5.3 If the required documentation or accessories are not provided at the time of appraisal or sale, you will have up to seven (7) days to provide the documents.

5.4 If the documents or accessories are not provided within this period, we reserve the right to re-evaluate the Vehicle’s valuation based on the information available at that time.

6. INSPECTION OF THE VEHICLE

6.1 The Vehicle must be made available for physical inspection before any sale is completed.

6.2 Any defects, damages, or discrepancies discovered during inspection may affect the valuation, and we reserve the right to issue a revised offer.

6.3 If the Vehicle is deemed unroadworthy or unsuitable for resale, we may decline to proceed with the purchase.

7. OWNERSHIP AND FINANCE

7.1 You must confirm that you are the legal owner of the Vehicle and have the legal right to sell it.

7.2 If the Vehicle is subject to any outstanding finance, you must provide full details of the finance agreement.

7.3 We will settle any outstanding finance on your behalf, deducting the amount from the agreed purchase price.

7.4 If the finance balance exceeds the agreed purchase price, you will be responsible for settling the remaining balance directly with the finance provider.

8. PAYMENT TERMS

8.1 If you accept the Offer, payment for the Vehicle will be made to your nominated bank account within five (five) working days from the date that the purchase order is signed by you or we have received all documentation relating to the Vehicle that we reasonably require, whichever is later. 

8.2 We will not be liable for any delays caused by incorrect or incomplete payment details provided by you.

9. LIMITATIONS AND EXCLUSIONS

9.1 We are not responsible for any items left in the Vehicle after the sale is completed. It is your responsibility to remove all personal belongings before the Vehicle is handed over.

9.2 Any valuations provided are subject to market fluctuations and may change after the seven-day validity period.

9.3 Nothing in these terms shall limit or exclude our liability for death or personal injury arising from Our negligence, or Our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

9.4 We will not be responsible or liable to you for any indirect or consequential losses or loss of income or revenue, loss of business, loss of profit, or loss of anticipated savings (whether direct or indirect). 

10. REVISED VALUATIONS

10.1 If discrepancies are found or documents are not provided within the specified timeframe, we reserve the right to re-evaluate the Vehicle and issue a revised valuation.

10.2 Any new valuation must be agreed in writing before completing the purchase.

11. YOUR LIABILITY

11.1 You agree to fully compensate us for any losses or expenses, including legal fees, that arise from your violation of these terms or any infringement of another person's rights. 

12. CANCELLATIONS 

12.1 Either party may cancel the transaction at any time before the sale is completed.

12.2 If you cancel the transaction after we have incurred any costs (e.g., collection fees), you may be liable for these costs.

13. GOVERNING LAW

13.1 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

13.2 Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. PERSONAL DATA

14.1 By selling your Vehicle to Us, you acknowledge and agree that your personal data will be processed in accordance with our Privacy Notice. We encourage you to review our Privacy Notice to understand how we collect, use and protect your information. A copy of Our Privacy Notice is available on our Website or at a participating dealership.
